Booking Terms and Conditions


We have tried to make our terms and conditions easy to read and understand. If you don’t understand any part of it please see our handy FAQ page or contact us and we can explain anything further.

1. Contract

The following terms and conditions, together with the information set out on the Tasmania MTB Tours website will form the contract between you and us for your tour or shuttle with us.

In this contract a reference to “you” and “your” include the lead-named person on the confirmation invoice (who must be at least 18 years old at the time of booking) and all persons on whose behalf a booking is made.

“we” and “us” means Tasmania MTB Tours.

“departure location” means the place specified by us as the place we will meet and start your tour or shuttle.

“departure date” means the date on which you board our transport at the departure location.

“shuttle” means a shuttle service organised by Tasmania MTB Tours.

“tour” means a mountain bike tour organised by Tasmania MTB Tours.

“tour or shuttle information”  means whatever documents we send to you in hard or soft copy to provide information about your tour or shuttle booking.

The contract between us comes into existence when we send out our confirmation invoice which confirms your booking. You will have undertaken to pay for the tour or shuttle you have booked, and we will have undertaken to provide you with the tour or shuttle that we describe in any advertising material and or on our web site.

If you make a booking on behalf of others as well as yourself, we shall take it that you have the authority of each of those other people to enter into that contract and that you and they have agreed to be jointly and severally liable to us. You now accept personal liability for the acceptance and compliance of each of those people, with these contract terms.

If we are unable to accept your booking, we will of course return your payment to you immediately.

For you to make a booking, we require a completed online booking form. Our confirmation invoice will be sent to you by email once your payment has been received and approved by us. We may decline your booking for any reason and we do not have to give you the reason. If that happens we will return your money to you immediately and in any event within 14 days.

2. Booking and Payment
2.1 Prices

All tour and shuttle prices are quoted in $AUD (Australian Dollar) currency and include 10% GST (goods & services tax).

2.2 Booking Deposit

No deposit is required for day tours or shuttle bookings. A 20% deposit is required for all multi-day tours. 

2.3 Payment Type

Payment may be made by Visa, Mastercard, Amex, and electronic bank transfer. Payment options will be provided at the time of booking.

2.4 Payment Surcharge Fee

If you make a payment using Visa, Mastercard or Amex the surcharge fee is 1.75%. There is NO fee’s for paying by direct bank transfer. This fee is what we as a business get charged to process the payment.

2.5 Final Payment and Failure To Pay
  • For multi-day tours, final payment is due to us 30 days before the tour departure date.
  • For shuttles and day tours, final payment is due at the time of making a booking.

If you do not pay us on or before when the final payment is due then we reserve the right to treat your booking as cancelled and we have the right to resell the seats(s). If we do that, you accept that a cancellation fee will be due to us. See 2.9 for cancellation fee’s.

2.6 Late Bookings

Any multi-day tour requested less than 4 weeks prior to the departure date must be accompanied by full payment at the time of booking.

2.7 Minimum Numbers
  • For multi-day tours, we require a minimum number of 3 participants.
  • For day tours, we require a minimum number of 2 participants.
  • For shuttles, we require no minimum numbers.
2.8 Refunds

Deposits are non-refundable (exceptions see 2.10) but in many cases your deposit may be transferable to another Tasmania MTB Tours tour or shuttle. If any tour does not meet the minimum numbers we have a right to cancel any tour for which there are insufficient reservations. In the event of any such cancellation, all deposits and other payments made to Tasmania MTB Tours will be refunded in full.

2.9 Cancellations by you

If you cancel your booking either through notifying us with a notice of cancellation or of your failure to pay the balance due or for any other reason, we charge a cancellation fee and is calculated as follows:

Multi Day Tours:

  • More than 60 days before departure, full refund less deposit.
  • Between 30 and 60 days before departure, 50% of your total tour booking.
  • Between 15 and 29 days before departure, 75% of your total tour booking.
  • 14 days or less before departure (or failure to join the tour), 100% of your total tour booking.

Day Tours:

  • More than 21 days before departure, full refund
  • Between 8 and 20 days before departure, 50% of your total tour booking.
  • 7 days or less before departure (or failure to join the tour), 100% of your total tour booking.   

 Shuttles:

  • More than 24 hours before the shuttle departure, 20% of your total shuttle booking.
  • Less than 24 hours before the shuttle departure, 100% of your total shuttle booking.

The above dates and times refer to the date that we receive notice of cancellation from you. If circumstances force you to leave a tour or shuttle early, you will have to bear any additional costs yourself.

If you are unavoidably prevented from joining a tour or shuttle, you may transfer your place to another person, providing this person meets any conditions which may apply to the booking and that we are informed of the transfer not less than 5 days prior to the tour or shuttle departure date or time.

In any circumstances giving rise to cancellation, we will consider allowing you to transfer the money you have paid, to an alternate tour or shuttle of you choose of the same or higher value only. Whether we do so is in our discretion, for which we do not have to give a reason.

2.10 Cancellation by us

For tours, we reserve the right to cancel any tour but not less than four (4) weeks prior to departure except for uncontrollable conditions set out in point 3.3. For shuttles, we reserve the right to cancel any shuttle but only for unforeseen circumstances out of our control. In the event of our cancellation, your deposit (and any other payment you may have made to us) will be refunded in full, or, if you prefer, transferred to an alternative Tasmania MTB Tours tour or shuttle.

3. General Tour
3.1 Tour Information

Multi-day tours:

4 weeks before the departure date, we shall send you an email and or text with important information relating to your tour. This information will include where to find certain tour related information on our website for reading or downloading:

  • Departure location and time of departure;
  • Clothing recommendations and a downloadable “what to pack” checklist;
  • And any other important information relevant to the holiday booked with us.

Day Tours & Shuttles:

1 week before the departure date, we shall send you an email or text with important information relating to your tour or shuttle. This information will include where to find certain tour related information on our website for reading or downloading:

  • Departure location and time of departure;
  • What to bring checklist;
  • And any other important information relevant to the tour or shuttle booked with us.
3.2 Accommodation

We will arrange accommodation as close as reasonably possible to the overnight tour destination. Accommodation can be in hotels, motels, lodges, cabins and cottages. Occasionally it may be necessary to use bed and breakfast accommodation. En-suite facilities will be provided wherever possible. Exact accommodation requirements can be chosen from our packages when you make a booking, but please note:

  • We reserve the right to change accommodation to that stated on our website itineraries – (see below “changes of itinerary”);
  • Our standard tour accommodation package is based on twin share. Single room supplements packages are available at an extra cost;
  • Accommodation in some of the older out of the way smaller country towns might be off a lower standard (but still very acceptable) than comparable accommodation in the big capital cities.
3.3 Changes of Itinerary

Despite careful planning, it is possible that a location may become inaccessible due to matters outside our control, for example through natural disasters. Tasmania MTB Tours reserves the right to alter the route, itinerary or to cancel the tour or shuttle if road, track and weather or other conditions dictate. No refund will be paid if for any reason the route is altered, and an alternative itinerary is offered. Any personal expenses and or damages incurred by a passenger as a result of any delay, curtailment or alteration of any tour or shuttle, whether caused by mechanical defect or any other causes or reasons, are the responsibility of the participant(s).

3.4 Baggage restrictions

Main Luggage Allowance. Due to travelling in a mini bus we have limited free space and weight restrictions. Guests are only permitted to bring one main bag with a max weight of 14 kg. No large or hard sided bags only soft duffle type or backpacks are allowed.

Carry-on Luggage. Guests are allowed to bring a second small carry-on bag to keep personal gear in with a max weight of 2 kg.

3.5 Travel Insurance

We strongly recommend that participants take out appropriate travel insurance to cover any unforeseen circumstances leading to cancellation or for any personal loss or injury. Cancellation insurance can be purchased or alternatively you can purchase comprehensive travel insurance.

3.6 Passport, Visa and Health Requirements

International participants please note:

  • To be absolutely safe, it is a good idea to make sure your passport is valid for at least six months after the date of return of your tour;
  • Remember to apply for any necessary visa in good time;
  • Check with your GP what vaccinations and medication you may require and allow time to obtain it.
3.7 Photo Consent

All tour and or shuttle participants consent to having their picture taken and consent for any images taken to be used for advertising and promotional purposes in any medium we choose. You grant us a perpetual, royalty-free, worldwide, irrevocable license to use such images for promotional purposes.

3.8 Limitations on our Liability

We want you to enjoy your tour or shuttle with Tasmania MTB Tours. We shall do our best to make your tour or shuttle special for you. Nonetheless, we must make clear the limitations in law. We are not liable to you for:

  • Any personal property that participants bring on any tour or shuttle that is damaged, lost or stolen during a tour or shuttle;
  • Any failure to meet any connecting services and or bookings as we are unable to guarantee the exact finish and departure times;
  • Any event which happens before you board our transport at the departure location or after you leave our transport at return;
  • Any problem arising from your failure to reach the departure location on time, for whatever reason (though we would do our best to help you in any way we reasonably could);
  • Any aspect of goods or services you buy or accept other than those arranged by us;
  • Medical problems or physical difficulties, even if you have told us about them in advance;
  • Medical emergencies;
  • Your own carelessness or negligence in any aspect of your behaviour whilst with us;
  • Laws, culture and standards of service and behaviour in any place or country we may visit;
  • Changes we reasonably make to an itinerary or to accommodation or any other aspect of the management of a tour or shuttle;
  • Problems or issues which we could resolve whilst on a tour or shuttle but which you raise only after your return.

Furthermore:

The services and features included in your tour or shuttle are those specified in our web site. If you choose to buy other goods or services during your tour or shuttle, those are not part of the package we provide, even if arranged through us. Accordingly, we are not liable to you for any happening in connection with that service or those goods.

3.9 Risk Acknowledgement and Liability Release
  • By booking a tour or shuttle service with Tasmania MTB Tours all participants acknowledge that the nature of the tour or shuttle service booked are adventurous and participation involves a degree of personal risk including serious injury or death.
  • All participants are aware and acknowledge that they will be visiting places where the geographical attributes present dangers and physical challenges that are greater than those in daily life.
  • All participants agree that they have acquainted themselves with the nature of the itinerary and that all participants acknowledge that their decision to participate in a tour or shuttle service is made in light of consideration of this information and that they accept and assume all the personal risks involved in any tour or shuttle service operated by Tasmania MTB Tours.
  • All participants acknowledge that to the fullest extent permitted by law, any liability for any loss, death, injury or damage which they may suffer, directly or indirectly in connection with or arising out of my participation in a tour or shuttle service is excluded.
  • All participants or their executor(s) release Tasmania MTB Tours, its officers, owners, employees, agents and representatives from any liability and expressly waive any claims that they may have rising out off or in connection with participation in any tour or shuttle service in any way.
4. Help we need from you
4.1 Participation & Behaviour

In addition to what information is given to you from our website about the tour the following are extra contractual matters:

  • Most Tasmania MTB Tours tours require reasonable physical fitness and appropriate knowledge of a mountain bike operation. You should be prepared to cycle up to 3-6 hours a day, on one or many various surfaces. These surfaces could be sealed, unsealed and dirt roads plus single tracks with steep down hill and mixed cross country terrain;
  • To satisfy the majority of our clients, we apply “no smoking” rules in the same way that they are applied by law in Australia;
  • If we provide medical help to you, whether or not you specifically ask for it, we will provide receipts for all costs (for your insurer) and you now agree to repay us that cost on your return from the tour or shuttle;
  • If at any time, it is our opinion (given by any of our staff or tour leaders) that you are acting in a way which may cause accident, injury, discomfort or extreme displeasure to any other tour or shuttle member, we may exclude you from the programme for the remainder of the tour or shuttle. You will understand that this extreme action will not be taken lightly but may be necessary to protect the health, safety or enjoyment of other clients. No refund or compensation is available if you are asked to leave the tour or shuttle early.
4.2 Complaints

We shall try our utmost to provide a happy and fulfilling tour or shuttle service, but if we fail in any way, do please raise any issue with the senior guide or driver immediately. If your complaint cannot be satisfied, it is not dealt with to your satisfaction at the time of reporting it to the senior guide or driver, then you should give us full details in writing, immediately on your return. We cannot respond to verbal complaints.

The validity, construction and performance of this agreement shall be governed by the laws of the State of Tasmania. Any dispute arising in connection with this agreement shall be subject to the exclusive jurisdiction of the Tasmanian courts.


Starlight Foundation Assumption of Risk and Liability Waiver 

This Starlight Foundation waiver is only relevant to;

Tour de Kids Red Centre Challenge 2019 (“the event”).

Tour de Kids Incorporated and Starlight Children’s Foundation (“the organisers”).

 I hereby release and forever discharge each of the organisers, its officers, employees, volunteers, agents, contractors and sponsors, from any and all claims, suits, demands, expenses, costs, actions and proceedings of any nature whatsoever, which I, my executors or administrators or any other person has or might assert against any of them arising from, in relation to, incidental to or by virtue of any injury, loss or damage suffered or sustained by me in connection with my participation in the event.

I hereby indemnify and hold harmless, and shall keep indemnified and held harmless, each of the organiser, its officers, agents, contractor and sponsors from and against all claims, suits, demands, expenses, costs, actions and proceedings of any nature whatsoever arising from, in relation to or by virtue of:-

(a)        Any injury, loss or damage sustained by me;

(b)        Any injury, loss or damage suffered by any other person as a result of any act, omission, neglect or default upon my part, in connection with my participation in the Event or at any time I am near the event.

I further acknowledge that I engage in the Event at my own risk and that cycling can be considered a dangerous sport which can result in injury out of an act or omission of a rider, other riders, other vehicles, spectators and other obstacles and track and road conditions and whilst all reasonable care is taken by organisers and officials when organising the Event, I acknowledge that I as a participant have an equal responsibility to ensure that I take all reasonable care in adhering to the rules and other conditions posed by the organisers and road rules to ensure a safe riding environment for all concerns.
