The following terms and conditions, together with the information set out on the Tasmania MTB Tours website will form the contract between you and us for your tour or shuttle with us.
In this contract a reference to “you” and “your” include the lead-named person on the confirmation invoice (who must be at least 18 years old at the time of booking) and all persons on whose behalf a booking is made.
“we” and “us” means Tasmania MTB Tours.
“departure location” means the place specified by us as the place we will meet and start your tour or shuttle.
“departure date” means the date on which you board our transport at the departure location.
“shuttle” means a shuttle service organised by Tasmania MTB Tours.
“tour” means a mountain bike tour organised by Tasmania MTB Tours.
“tour or shuttle information” means whatever documents we send to you in hard or soft copy to provide information about your tour or shuttle booking.
The contract between us comes into existence when we send out our confirmation invoice which confirms your booking. You will have undertaken to pay for the tour or shuttle you have booked, and we will have undertaken to provide you with the tour or shuttle that we describe in any advertising material and or on our web site.
If you make a booking on behalf of others as well as yourself, we shall take it that you have the authority of each of those other people to enter into that contract and that you and they have agreed to be jointly and severally liable to us. You now accept personal liability for the acceptance and compliance of each of those people, with these contract terms.
If we are unable to accept your booking, we will of course return your payment to you immediately.
For you to make a booking, we require a completed online booking form. Our confirmation invoice will be sent to you by email once your payment has been received and approved by us. We may decline your booking for any reason and we do not have to give you the reason. If that happens we will return your money to you immediately and in any event within 14 days.
All tour and shuttle prices are quoted in $AUD (Australian Dollar) currency and include 10% GST (goods & services tax).
No deposit is required for day tours or shuttle bookings. A 20% deposit is required for all multi-day tours.
Payment may be made by Visa, Mastercard, Amex, and electronic bank transfer. Payment options will be provided at the time of booking.
If you make a payment using Visa, Mastercard or Amex the surcharge fee is 1.75%. There is NO fee’s for paying by direct bank transfer. This fee is what we as a business get charged to process the payment.
If you do not pay us on or before when the final payment is due then we reserve the right to treat your booking as cancelled and we have the right to resell the seats(s). If we do that, you accept that a cancellation fee will be due to us. See 2.9 for cancellation fee’s.
Any multi-day tour requested less than 4 weeks prior to the departure date must be accompanied by full payment at the time of booking.
Deposits are non-refundable (exceptions see 2.10) but in many cases your deposit may be transferable to another Tasmania MTB Tours tour or shuttle. If any tour does not meet the minimum numbers we have a right to cancel any tour for which there are insufficient reservations. In the event of any such cancellation, all deposits and other payments made to Tasmania MTB Tours will be refunded in full.
If you cancel your booking either through notifying us with a notice of cancellation or of your failure to pay the balance due or for any other reason, we charge a cancellation fee and is calculated as follows:
Multi Day Tours:
The above dates and times refer to the date that we receive notice of cancellation from you. If circumstances force you to leave a tour or shuttle early, you will have to bear any additional costs yourself.
If you are unavoidably prevented from joining a tour or shuttle, you may transfer your place to another person, providing this person meets any conditions which may apply to the booking and that we are informed of the transfer not less than 7 days prior to the tour or shuttle departure date or time.
In any circumstances giving rise to cancellation, we will consider allowing you to transfer the money you have paid, to an alternate tour or shuttle of you choose. Whether we do so is in our discretion, for which we do not have to give a reason.
For tours, we reserve the right to cancel any tour but not less than four (4) weeks prior to departure. For shuttles, we reserve the right to cancel any shuttle but only for unforeseen circumstances out of our control. In the event of our cancellation, your deposit (and any other payment you may have made to us) will be refunded in full, or, if you prefer, transferred to an alternative Tasmania MTB Tours tour or shuttle.

We will arrange accommodation as close as reasonably possible to the overnight tour destination. Accommodation can be in hotels, motels, lodges, cabins and cottages. Occasionally it may be necessary to use bed and breakfast accommodation. En-suite facilities will be provided wherever possible. Exact accommodation requirements can be chosen from our packages when you make a booking, but please note:
Despite careful planning, it is possible that a site may become inaccessible due to matters outside our control, for example through natural disasters. Tasmania MTB Tours reserves the right to alter the route, itinerary or to cancel the tour or shuttle if road, track and weather or other conditions dictate. No refund will be paid if for any reason the route is altered, and an alternative itinerary is offered. Any personal expenses and or damages incurred by a passenger as a result of any delay, curtailment or alteration of any tour or shuttle, whether caused by mechanical defect or any other causes or reasons, are the responsibility of the participant(s).
Main Luggage Allowance. Due to travelling in a mini bus we have limited free space and weight restrictions. Guests are only permitted to bring one main bag with a max weight of 14 kg. No large or hard sided bags only soft duffle type or backpacks are allowed.
Carry-on Luggage. Guests are allowed to bring a second small carry-on bag to keep personal gear in with a max weight of 2 kg.
We strongly recommend that participants take out appropriate travel insurance to cover any unforeseen circumstances leading to cancellation or for any personal loss or injury. Cancellation insurance can be purchased or alternatively you can purchase comprehensive travel insurance.
International participants please note:
All tour and or shuttle participants consent to having their picture taken and consent for any images taken to be used for advertising and promotional purposes in any medium we choose. You grant us a perpetual, royalty-free, worldwide, irrevocable license to use such images for promotional purposes.
We want you to enjoy your tour or shuttle with Tasmania MTB Tours. We shall do our best to make your tour or shuttle special for you. Nonetheless, we must make clear the limitations in law. We are not liable to you for:
The services and features included in your tour or shuttle are those specified in our web site. If you choose to buy other goods or services during your tour or shuttle, those are not part of the package we provide, even if arranged through us. Accordingly, we are not liable to you for any happening in connection with that service or those goods.
In addition to what information is given to you from our website about the tour the following are extra contractual matters:
We shall try our utmost to provide a happy and fulfilling tour or shuttle service, but if we fail in any way, do please raise any issue with the senior guide or driver immediately. If your complaint cannot be satisfied, it is not dealt with to your satisfaction at the time of reporting it to the senior guide or driver, then you should give us full details in writing, immediately on your return. We cannot respond to verbal complaints.
The validity, construction and performance of this agreement shall be governed by the laws of the State of Tasmania. Any dispute arising in connection with this agreement shall be subject to the exclusive jurisdiction of the Tasmanian courts.
This Starlight Foundation waiver is only relevant to;
Tour de Kids Red Centre Challenge 2019 (“the event”).
Tour de Kids Incorporated and Starlight Children’s Foundation (“the organisers”).
I hereby release and forever discharge each of the organisers, its officers, employees, volunteers, agents, contractors and sponsors, from any and all claims, suits, demands, expenses, costs, actions and proceedings of any nature whatsoever, which I, my executors or administrators or any other person has or might assert against any of them arising from, in relation to, incidental to or by virtue of any injury, loss or damage suffered or sustained by me in connection with my participation in the event.
I hereby indemnify and hold harmless, and shall keep indemnified and held harmless, each of the organiser, its officers, agents, contractor and sponsors from and against all claims, suits, demands, expenses, costs, actions and proceedings of any nature whatsoever arising from, in relation to or by virtue of:-
(a) Any injury, loss or damage sustained by me;
(b) Any injury, loss or damage suffered by any other person as a result of any act, omission, neglect or default upon my part, in connection with my participation in the Event or at any time I am near the event.
I further acknowledge that I engage in the Event at my own risk and that cycling can be considered a dangerous sport which can result in injury out of an act or omission of a rider, other riders, other vehicles, spectators and other obstacles and track and road conditions and whilst all reasonable care is taken by organisers and officials when organising the Event, I acknowledge that I as a participant have an equal responsibility to ensure that I take all reasonable care in adhering to the rules and other conditions posed by the organisers and road rules to ensure a safe riding environment for all concerns.
